Road Tours Terms and Conditions
Participants attend Circuit Days Events at their own risk and any liability for individuals and/or their cars rests with them.
General Event Guidelines
Circuit Days Road Tours are non competitive, social driving Events. The Events are not races, rallies or time trials. You must NOT compete in any manner with other participants. You must drive safely and with proper courtesy to all other participants and members of the public.
Responsible Behaviour
You must comply with all applicable laws and regulations of the Country in which you are travelling, including all speed regulations, laws of the road, laws relating to the safety of your vehicle and laws relating to the possession or use of prohibited substances. Circuit Days Limited accepts no responsibility for the consequences of you being refused passage and/or entry/exit to or from any Country visited en route, and in particular any additional costs incurred are your own responsibility. You must not drive if your ability to do so safely and properly is in any way compromised by illness, lack of adequate rest, or any other condition.
Insurance
Appropriate insurance includes cover for driving abroad (check your policy - most standard agreements cover this), third party liability, and medical cover for you. If you are in any doubt whatsoever please check with your insurance company prior to booking.
Booking and Cancellation Policy
The initial deposit and any subsequent balance payments are non refundable under any circumstances. A full or partial credit may be issued should we be given sufficient notice of a cancellation.
Should any Event be cancelled for reasons beyond our control, no refunds can be issued. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural disasters, natural disturbances including volcano eruptions, fire, epidemics, pandemics, health risks, changes due to rescheduling or cancellation of flights by an airline, closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, and any other similar event.
Privacy Policy
We do not store your details other than your email address, which we will use only to send you essential Event information and the link to view the Event photos. We do not share your email address with any 3rd parties other than those used for an important part of an Event (your email address has to be provided to Eurotunnel for API submission purposes for example). If you opt in to our mailing list, we will save your email address securely and only use it to contact you with information about our Events.
Declaration & Indemnity
I confirm that:
1. I acknowledge and realise that participation in an Event such as a Circuit Days Tour is potentially dangerous and that there are numerous risks associated with my participation. Such risks and dangers include, but are not limited to, traffic accidents, collisions with pedestrians, vehicles, other drivers, and/or fixed or moving objects, and the negligence of other drivers. Further, I fully understand and realise that my participation in any Event may result in serious bodily injury and/or death to myself or others. I further realise and understand that the route of the Events will require driving on public roadways upon which the hazards of travelling are to be expected. Further, I realise that participation in any Event will require strenuous physical exertion as participants will be required to drive for very long periods of time over several days, including the risk of driving through inclement weather.
2. With full knowledge and understanding of the risks associated with my participation in any Event, I enter the Event voluntarily and fully accept and assume every such risk for loss, damage, or injury (including death).
3. By booking any Event I agree to comply with all of the Event's terms and conditions of entry. I acknowledge and understand that the Organiser of the Event will use reasonable efforts to ensure that all other participants abide by the terms and conditions of entry, but cannot guarantee that the participants will abide by these terms and conditions.
4. Upon booking and being permitted to participate in any Event, I hereby waive, release, and forever discharge, for myself, my heirs, executors, administrators and legal representatives, any and all rights and/or claims which I have, may have, or may hereafter accrue to me against the Organiser, its officers, directors, employees, consultants, agents and Event sponsors for any and all damages, injuries (including death), and/or claims which may be sustained by me directly or indirectly arising out of my participation in any Event (including the application of emergency or medical services at the Event) even if the damages, injuries (including death), and/or claims are caused by the negligence of those persons listed above or otherwise. Further, I covenant not to sue the Organiser, its officers, directors, employees, consultants, agents and Event sponsors for any and all damages, injuries (including death), and/or claims which may be sustained by me directly or indirectly arising out of my participation in any Event. This release and discharge includes, but is not limited to, claims for personal injury, death, property damage, economic loss, breach of contract, lost wages, contribution indemnity, indemnity, punitive damages, negligence, or any other legally recognisable claim arising out of my participation in any Event (including all legal costs associated with such claims).
5. I hereby agree to release, defend, indemnify, and hold harmless the Organiser, its officers, directors, employees, consultants, agents, Event sponsors and licensees and assigns from and against any and all claims, demands, damages, suits, liabilities or actions arising directly or indirectly out of my actions or otherwise from my participation in the Event whether made or claimed during or after the Event, including all associated costs and expenses and any amounts which the Organiser may pay as a settlement or compromise of any such claims or liabilities.
6. I have read this waiver, fully understand its terms, and understand that I have given up substantial rights by signing it (physically or electronically via the website). I have done so freely and without inducement, coercion, or duress. I intend this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that, if any portion of this waiver is held to be invalid, that the balance of the waiver shall continue in full force and effect.
7. By booking the Event I declare that all the information contained on the entry form is correct and I acknowledge that I have read and understood all the terms and conditions and I agree in full to the terms and conditions above (including those of the waiver and indemnity) and I accept all the terms and conditions relating to my participation in the Event.
I have read and hereby make the participant declaration set out above and agree that the terms will also apply to my participation on any future event organised by Circuit Days Ltd.
